Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling from and being crushed by the wheels of earth-moving equipment while not wearing seat belts installed by the equipment manufacturer to prevent such fall: The operator of the Skytrack highlift vehicle, job site. Student housing site is located at 6433 Maple Avenue, Dallas, Texas 75235. or, in the alternative: 29 CFR 1926.95: Personal protective equipment was not used whenever necessary by reasons of hazards encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact: Seat belts were not being used by the operators of the Skytrack highlift vehicle; job site.
