Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which was free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
On or about Friday March 29, 2002 Jackson Meadows Subdivision 3800
Rosewood at Miles Rd.
Sachse, Texas.
Three employees, who had been conducting "blocking" operations, were
observed climbing into
the bucket of a front end loader and riding in the bucket across the
construction site from the
section pipe joints they had just completed supporting to the next set of
joints. The bucket was
raised approximately two feet above the ground and the loader was
traveling an estimated ten
to fifteen miles per hour across two hundred fifty to three hundred yards
of open rough terrain
of the construction site.
Among other methods, feasible abatement methods include:
1. Develop and implement a comprehensive safety-training program, to
include a disciplinary
program, to be successfully completed prior to permitting employees to
operate heavy
equipment.
2. Prohibit the practice of allowing employees to ride in the bucket of a
front-end loader.nd
