Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm in that
employees were exposed
to the hazard of:  The employer did not furnish employment and a place of
employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical
harm to employees in that employees were exposed to a crushing hazard as a
result of tipover:
a)  On site - The operator was not using the seat belt while operating a
Trak International
Industrial Truck on the construction site, on or about 09/19/00.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to have the operators use the seat belt was
supplied
by the manufacturer on the
equipment.er
