Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by a moving vehicle: (a) Tow Truck (license number 418LWP) - Truck was not inspected on an annual basis. Among other methods, one feasible and acceptable abatement method to correct this hazard is to comply with the Georgia Department of Transportation, regulation 396.17, to annually inspect the commercial motor vehicle (tow truck), and regulation 393.41, to correct defective parking brake system.
