Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being trapped under forklift in a rollover situation: (a) Warehouse, Paint department-Caterpillar 10,500 lb forklift, serial #5MB0120: Hazard of injury or death from rollover of forklift due to a defective seatbelt while operating forklift. One feasible and acceptable abatement method to correct the hazard would be to replace or repair the seatbelt. Regular inspections should be conducted on the forklifts to ensure that the seatbelts are secure and operational. (b) Warehouse area-Caterpillar GC-25, 5,000 lb forklift, SN 4EM08263: Manufactured seat with seatbelt had been replaced with a seat which did not have a seatbelt. Hazard of injury or death from rollover of forklift. One feasible and acceptable method to correct the hazard would be to replace the existing seat which has no seatbelt with a seat which has a seatbelt that meets manufacturer's specifications. ABATEMENT DOCUMENTATION AND CERTIFICATION REQUIRED
