Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees, in that
employees were exposed to potential injuries from a vertical conveyor
hoist, such as, but not
limited to falls and crushing injuries:
(a)Main Store, E. Main Street: On or about November 8, 2000, and at times
prior thereto, employees would ride, between three (3) floors a total of
21 feet
apart, a vertical reciprocating conveyor (material hoist) not intended or
designed to safely carry passengers.  The hoist did not meet the minimum
requirements to comply with ANSI/ASME B20.1-1987, Safety Standard for
Conveyors and Related Equipment.  See appropriate rule violations noted
below:
1.Rule 6.21.1(c): Personnel were not forbidden to ride the conveyor.
Warning signs to this effect were not prominently posted at each point
of access and each point of operation.
2.Rule 6.21.2(b): The conveyor housing was not equipped with doors or
an equivalent device at each manual loading and unloading station,
interlocked so that they can be opened only when the carrier has
stopped at that level and the carrier cannot be moved until they are
closed.  This exposed employees to fall hazards up to 21 feet into the
conveyor shaft.
3.Rule 6.21.2(e): Controls were not installed or located so they cannot be
actuated by a person on the carrier.
Note: This is not a conclusive list of deficiencies for this elevator.
Among other methods, feasible and acceptable abatement methods to correct
this hazard
include:
1. Install safety equipment described above, bring the hoist into
compliance
with ANSI/ASME B20.1, and prohibit employees or other persons from riding
the platform between floors.
and/or
2.  Install and use an elevator designed for passengers in accordance with
American National Standard Safety code for Elevators, ANSI A17.1.
and/or
3.  Remove the hoist from service and install a stairway which meets all
applicable OSHA and building codes.ng
