Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling from a forklift seat: (a)On or about 1 NOV 00, and at times prior thereto, a Toyota forklift truck was operated without the protection of a seat belt. The truck was originally manufactured with a seat belt and it had been removed. Among other methods, one feasible and acceptable abatement method to correct this hazard is to re-attach a seat belt to the forklift's seat. Note : Abatement certification required for this item.
