Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of roof collapse: (a)Outside Building 3: On or about January 16, 2001 and at times prior thereto, an employee was operating a Cat 50 powered industrial truck, model number F50DSA, serial number 2MD00206, without wearing a seat belt. (b)Outside Building 4, West Side: On or about January 16, 2001, an employee was operating a Cat powered industrial truck, model number GP 25, serial number 58AM92600, without wearing a seat belt. "AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO REQUIRE THE USE OF SEAT BELTS WHEN OPERATING FORKLIFTS (POWERED INDUSTRIAL TRUCKS) THROUGHOUT THE ESTABLISHMENT AS REQUIRED BY ANSI/AMSE B56.1-1993, PARAGRAPH 5.3.19." Note: Abatement certification required for this item.
