Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being thrown from a powered industrial truck: (A)Yard: On 23 May 2001, an employee was observed operating a Komatsu powered industrial truck without wearing the seat belt. (B)Yard: On 23 May 2001, an employee was observed operating a Komatsu powered industrial truck without wearing the seat belt. Note: Abatement certification required for this item. ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD, AMONG OTHERS, TO CORRECT THIS HAZARD IS TO: train employees on the proper use of seat belts and have supervisors check to ensure they are adhering to the training.
