Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees are exposed to crushing injures from failure to have procedures
in place which
prevents tractor-trailers from being moved while powered industrial trucks
are being operated
inside trailers:
(A)Loading Dock #11: On or about 16 July 2001, the trailer securing system
the
employer used failed to prevent an employee from being injured when he
backed a powered industrial truck out of a trailer as the tractor driver
pulled
the trailer away from the loading dock.
(B)Loading Dock Area: On or about 16 July 2001, and at times prior thereto,
powered industrial trucks were permitted to enter and exit tractor-trailer
rigs
without an effective policy in place to ensure the trailer remains
stationary
until the powered industrial trucks were out of the trailer.
