Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about October 26, 2000 at the job site located at 1301 South Shackleford Road, Little Rock, Arkansas, an employee was operating the Ford New Holland 555E tractor with front end loader and back hoe attachments without wearing the seat belt provided, exposing the employee to the hazard of being struck by the tractor or attachments if he were ejected from the seat or struck by the roll over protective structure or other parts of the tractor if the tractor turned over. Feasible abatement methods could include but are not limited to: 1.Wear the seat belt provided on the tractor. Disclaimers: The employer is not limited to the abatement methods suggested by OSHA. The methods explained are general and may not be effective in all cases. The employer is responsible for selecting and carrying out an appropriate abatement method.nt
