Nevada Revised Statute 618.375(1):  The employer did not furnish
employment and a place of
employment which was free from recognized hazards that were causing or
likely to cause death
or serious physical harm to employees:
a.A operator of Olympic Framers Inc. at Ambassadors Suites, 4350 Paradise
Road,
Las Vegas, Nevada was operating the GEHL DL 633 Dynalift Telescoping Boom
Forklift Truck, without making sure that all personnel were clear of the
placement area of an elevated beam system.  The employer did not develop
and
implement a policy and/or training program to ensure that all personnel
understood the hazards associated with working underneath the elevated beam
system.  The one employee on a ladder was struck by the displaced beam
system
and fell approximately 16 feet to ground level.  The forklift truck
elevation of the
beam system was approximately 20 feet in height.

Chapter 6, Operations & Adjustments, Load Elevation and Placement: Use
extreme caution for high placement.  Make sure personnel are clear of the
area
where the load could tip or fall.
One feasible and acceptable method, among others, is to ensure that each
operator
of the forklift trucks are trained to recognize that hazards associated
with
personnel being underneath elevated loads that may displace.
