Nevada Revised Statute 618.375(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)The employer failed to respond appropriately to diffuse workplace violence issues which arose during the May through June 2000 time frame at the Turnberry Place Construction Project. Verbal threats and physical altercations occurred between a management representative and numerous employees which had the potential of escalating into a major confrontation that could have resulted in the serious injury or death of one or more employees. One feasible method of abatement would be to implement the provisions of the Job Site Violence Policy that M.J. Dean Construction, the construction and safety management general contractor, had drafted and enforced as part of their over-all job site safety program.
