Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazrds that
were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to being struck by vehicular traffic:
a.On or about December 12, 2001, Highway 98 westbound, west of intersection
with Summer Breeze Road, Panama City Beach, Florida, one employee
performing surveying work was struck by oncoming vehicular traffic which
resulted in his death.  The employer did not ensure that the survey work
zone
was appropriately identified to alert oncoming motorists.  The survey work
zone deficiencies included the following:
1.Signing for the control of traffic entering the survey work zone
by way of intersecting roads was not provided to make drivers
aware of the survey work zone conditoins.
2.A flagman was not provided to warn approaching traffic of the
work zone, and to direct traffic if necessary.
3.A Type B Light or dual orange flags were not used to enhance
the "Survey Crew Ahead" sign.
4.A "Stay In Your Lane" sign was not added to the advance
warning sign sequence as the second most immediate sign from
the work area.
Among other methods, recognized and feasible means of abatement to correct
this hazard include, but not limited to: Full implementation of the
applicable
elements required by the State of Florida, Department of Transportation,
Roadway and Traffic Design Standards for Design, Construction, Maintenance
and Utility Operations on the State Highway System, January 2000 Edition.
ABATEMENT CERTIFICATION IS REQUIRED.TION
