Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries from vehicles that were backing: a.On or about May 31, 2002, 3506-3510 Rain Forest Drive West, Jacksonville, Fl: The employer did not ensure that proper backing procedures were followed during residential garbage collection. A thrower/helper walked behind rear loader refuse truck 593 while it was backing towards trash cans, and the truck had not come to a complete stop. When the driver lost sight of the thrower/helper, he did not immediately stop the truck from backing. The truck backed over the thrower/helper and killed him. b.On or about July 26, 2002, Hoovering Mist Way & Caroline Vale Boulevard, Jacksonville, Fl: The employer did not ensure that proper backing procedures were followed during residential garbage collection. A thrower/helper rode the riding step while the rear loader refuse truck was backed down the street from the corner of Caroline Vale Boulevard and Hoovering Mist Way to the driveways in front of homes 7607 and 7609. Among other methods, one feasible and acceptable method to correct this hazard is to enforce compliance with American National Standard for Refuse Collection, Processing and Disposal Equipment, Mobile Refuse Collection and Compaction Equipment Safety Requirements, ANSI Z245.1-1992, and ensure the following: 1.Provide instruction and training in safe methods of work before assigning employees to operate the equipment. 2.Maintain records of the names of the employees trained and the dates of the training. 3.Monitor the employee's operation of equipment and take appropriate action to ensure proper use of the equipment, including adherence to safe practices. 4. Establish and follow a program of periodic and regular inspections of all equipment and keep all records of inspections. 5. Remain at the operator's position during collection activities until the vehicle has come to a complete stop and the brakes are set. 6.That no persons ride on steps when the vehicle is operating in reverse. ABATEMENT CERTIFICATION IS REQUIRED.
