Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck by hazard: a.On or about April 14, 2003, the John Deere, Model 401D, tractor was not maintained in proper operating condition. The equipment operator started the tractor while standing between the front and back tires, the tractor jumped into gear, struck, and ran over the operator. Among other methods, two feasible means of abatement would be: 1.Start engine according to manufacturer recommendations. NEVER start engine while standing on ground. Start engine only from operator's seat. 2.Perform scheduled maintenance according to manufacturer recommendations. Also, when maintenance is required which is greater in scope than the individual shop can repair, contact the manufacturer for guidance. ABATEMENT CERTIFICATION IS REQUIRED.TION
