North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)facility -- an under-the-hook job made lifting device, used to lift and install flywheels onto wood chipping machines, was not, load tested, labeled with maximum load limit, inspected prior to initial use and was not provided with frequent and periodic inspections. REFERENCE:ANSI B30.20-1985, Chapter 20-1 NOTE:Among other methods, one feasible and acceptable method of abatement of these hazards is to inspect the lifting device, load test the device, label the device with the maximum load limit authorized.
