North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees conditions of employment and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees:
a)facility wide -- inspector failed to inform the employer
that identified deficiencies would deadline overhead
hoisting equipment.
NOTE:Among other methods of abatement, one feasible and
acceptable method to correct this hazard is to
reprint your inspection sheet to include a
statement that the hoisting device should be
removed from service until the hazard(s) are
corrected (if warranted) and then train your
inspectors that they must inform the facilities
manager(s) verbally that the equipment should be
removed from service until the hazard(s) are
corrected and then have the facilities manager sign
the form indicating that they are aware of the
hazard(s) and the necessity of having the hoist
removed from service until it is repaired.
