Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard when forklifts were used to elevate them above floor grade for access to the upper tiers of the storage racks. Among other methods, some feasible and acceptable methods to abate this hazard are: (1), follow the forklift manufacturer's instructions; (2), substitute the forklift for a ladder, scaffold, or other suitable equipment; or (3), utilize a safety platform with the forklift which meets the specifications of ANSI B56.1-1993, or later edition. No abatement certification or documentation is required for this item.
