North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)on the construction site, Garden Oaks sub-division, the employer failed to insure the braces were not removed prior to the installation of the party walls. NOTE: Among other methods, the feasible and acceptable method to abate these hazards is to develop an "erection procedure" for the construction of the modular units involving the "craning process" with subsequent employee and sub-contractor training. In addition, walk-through inspections should be conducted by the Project Manager or his designee at intermittent stages of the construction to insure activities are in sequence. b)on the construction site, Garden Oaks sub-division, the employer failed to insure the nails were driven through the braces into the floor joists. NOTE: Among other methods, the feasible and acceptable method to abate these hazards is to insure nails are completely driven through the braces into the floor joists. c)on the construction site, Garden Oaks sub-division, the employer failed to insure the brace capacity information, evaluated by a PE (License No 15859), accounted for the additional weight of the second floor platform and exterior and interior walls, in addition to the roof and truss unit. NOTE: Among other methods, the feasible and acceptable method to abate these hazards is to insure the brace capacity is re-evaluated by an RPE and the additional weight of the second floor platform, exterior and interior walls of the second floor and the roof and truss unit, is accounted for.unted
