Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to multiple injuries and death from the unsecured platform
displacement,
inadequate guard rails (fall protection), and tipping over hazard when
using an oversized, non-
secured, and inadequate guard railed platform on a rough terrain forklift:
(a) Employees were exposed to multiple injuries and death hazards created
by the use of elevated
work platform which was not designed, constructed, and/or used in
accordance with the
acceptable requirements the American National Standard for Rough Terrain
Forklift Trucks,
ASME/ANSI B56.6a-1994 and other acceptable industry practices. For
Example: The platform
did not meet the following design and use requirements of sections 5.15
and 8.25 of
ASME/ANSI B56.6a in the following areas: (1) Platform dimensions exceeded
in
width more
than 10 inches greater than the overall width of the truck on either side,
(2) Did not have toe
plates, (3) Did not have guard rails on the front and midrails on the
other sides and/or a body
belt and lanyard used when guard rails were omitted, (4) The platform was
not attached to the
forks or lifting mechanism (5) Did not have the maximum work load and
empty weight
information prominently marked on the platform (6) Controls were not
installed on the elevating
platform nor was an operator at the truck controls while employees were
elevated, (7) The
platform was not lowered when the rough terrain forklift was being
repositioned, (8) The area
below the suspended basket was not marked.
The above conditions were observed when an employee was installing foam
backing for stucco
in a platform on the forks of a rough terrain forklift 16 feet above
ground level.
Among other methods, feasible and acceptable means to correct these
hazards
are to use safer
alternate methods, such as a scaffold or use a platform approved by the
manufacturer meeting
the design, manufacture, and use requirements of ASME/ANSI B56.6a-1994 for
all attachments
on rough terrain forklifts.
