Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to severe burn injuries caused by ignition of combustible
dust:
a) The Bobcat used for clean up of charcoal dust was not approved for use
in
areas with combustible dust.
b) The wheelbarrow and shovel used for clean up of the charcoal dust were
not
non-spark producing.
Among other methods, feasible and acceptable abatement methods to correct
this
hazard, but not limited to:
1) Ensure that only vehicles that are approved for use in areas where
combustible
dust is present are used.
2) Use only non-spark producing tools during the clean up of combustible
dust.
3) Wet down the dust prior to begining clean up.
and/or
4)Train employees and develop a safe procedure to clean up combustible
dust.
Abatement Certification or Abatement Documentation required.
