Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to multiple injuries or death from an unsecured platform, inadequate guard rails (fall protection), and tipping over hazard when using an oversized, non-secured, and inadequately guarded platform on a rough terrain forklift. (a) At the site, employees were exposed to multiple injuries and/or death created by the use of an elevated work platform which were not designed, constructed, or used in accordance with the acceptable requirements of the American National Safety Standards for Rough Terrain Forklift Trucks, ASME/ANSI B56.6a-1998 and other acceptable industry practices. For example, the platform did not meet the following design and use requirements of sections 8.25 and 5.15 of ASME/ANSI B56.6a in the following areas: (1) Platform dimension exceeded in width more than 10 inches greater than the overall width of the truck on either side, (2) Did not have the maximum work load and empty weight information prominently marked on the platform, (3) Platform was not attached to the forks or lifting mechanism, (4) Did not have the front guard rail at a height of 42 inches and/or a body harness and lanyard used, (5) Controls were not installed on the elevating platform and/or an operator at the truck controls (6) The platform was not kept horizontal, and (7) The area adjacent to the door below the basket was not marked. The above conditions were observed when an employee was installing siding on a pole building using a platform on a Sky Track rough terrain forklift. Among other methods, feasible and acceptable means to correct these hazards are to use safer alternate methods such as a scaffold or use a platform approved by the manufacturer meeting the design, manufacture, and requirements of ASME/ANSI B56.6a-1994 for all attachments on rough terrain forklifts. Abatement Certification and Abatement Documentation required.
