Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to multiple injuries and/or death while standing on the guard rails of an elevated work platform: a) At the site, employees were exposed to multiple injuries and/or death created by the improper use of an elevated work platform. The scissor lift was not used in accordance with the acceptable requirements of the American National Safety Standards for Self propelled Work Platforms ASME/ANSI A92.6 and other acceptable industry practices. For example the employees did not follow and use the requirements of section 7.10.9 of ASME/ANSI A92.6 Personnel shall maintain a firm footing on the platform floor while working thereon. Climbing by occupants on the midrail or toprail of the aerial platform is prohibited. On the westside of the building, one employee was exposed to falls of approximately 15 feet when standing on the midrail of the scissor lift platform. No Abatement Certification or Abatement Documentation is required.
