Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to Falls while standing on the guard rails of an elevated
work platform:
a) At the site, employees were exposed to multiple injuries and/or death
created by the
use of an elevated work platform which were not designed, constructed,
and/or used in
accordance with the acceptable requirements of the American National
Safety Standards for Self
propelled Work Platforms ASME/ANSI A92.6 and other acceptable industry
practices. For
example the employees did not follow and use the requirements of section
7.10.9 of
ASME/ANSI A92.6 Personnel footing- Personnel shall maintain a firm footing
on the platform
floor while working thereon. Climbing by occupants on the midrail or
toprail of the aerial
platform is prohibited. The use of planks, ladders, or any other devices
on the platform for
achieving additional height or reach is prohibited.
One employee was exposed to falls of approximately 17 feet when standing
on the midrail
of the scissor platform lift while working at the entrance overhang.
Abatement Certification and Abatement Documentation not required.
