Section 5(a)1 of the Occupational Safety And Health Act of 1970. The employer did not furnish employment and place of employment which were free from recognized hazards that were causing of likely to cause death or serious harm to employees, in that employees were exposed to multiple injuries or death from using an oversized platform on a rough terrain forklift and standing on the top rail of the work platform. At the site, employees were exposed to multiple and/or death by use of an elevated work platform which was not designed, constructed, and/or used in accordance with the acceptable requirements of the American National Safety Standards for Rough Terrain Forklift Trucks, ASME/ANSI B56.6a-1998 and other acceptable industry practices. For example, the platform did not meet the following design and use requirements of section 8.24 and 5.15 of ASME/ANSI B56.6a in the following areas; (1) Platform dimension exceeded in width more that 10 inches greater than the overall width of the truck on either side. (2) Personnel are prohibited to use as railings for the purpose of achieving additional height. (a)The above conditions were observed when the employees were installing windows in a personnel basket that was 6 foot wider than the wheelbase, installing trim on the west side of the building. An employee was standing on the top rail of the platform exposed to a fall of 19 feet. Among other methods, feasible and acceptable means to correct these hazards are to use a safer alternate methods such as the use of a scaffold or a platform approved by the manufacture meeting the requirements of ASME/ANSI B56.6a 1998 for attachments on rough terrain forklifts. Abatement Certification and Abatement Documentation required.
