Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to multiple injuries or death from jumping from the top rail
of an elevated work
platform to the roof without fall protection:
(a) Employees were exposed to multiple injuries and/or death created by
the improper utilization
of an elevated work platform which was not used in accordance with the
acceptable requirements
of the American National Standards Institute for Self-Propelled Elevating
Work Platforms, ANSI
A92.6-1999 and other acceptable industry work practices. For example,
paragraphs 7.10-9 and
8.10-9 require personnel to maintain firm footing on the platform floor
while working thereon
and prohibits climbing by occupants on the midrail or top rail of the
aerial platform.
At the front entrance of the site, an employee was exposed to a fall
hazard of over 14 feet when
climbing to the top of the top railing on a self-propelled elevating work
platform and jumping
over 2 feet, 7 inches from the top railing to the roof surface.
Among other methods, feasible and acceptable measures to correct this
hazard would be to use
a properly positioned extension ladder to access the roof.
