Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees from driving off
of a loading dock, when using a dock lock system in properly:
At the establishment, employees were exposed to multiple injuries and/or
death created by the
use of an unsecured dock lock system.  The dock lock system was not used
in accordance with
the acceptable requirements of Kelley Dock Systems, Truk Stop Trailer
Restraint, Star 4-Low
Profile, Owners Manual: Page number 11, Paragraph 3; requires the Forklift
operator to enter
the truck only when the green signal light on the control box is on.
(a) Employees were loading and unloading the trailers at the company with
the Kelly Dock
System bypassed.  Truck drivers were signaled manually to leave the
loading dock (due to the
Kelly system being bypassed) resulting in a Fork lift driving of the dock
as a truck pulled out.
Among other methods, feasible and acceptable means to correct these
hazards are to use the
Kelley Star 4 Truk Stop Trailer Restraint as intended by the manufacturer.
No Abatement Certification or Abatement Documentation required.
