Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) On or about July 22, 2003, an employee of James J. Calmes and Sons, Inc. left an rough terrain forklift unattended. ASME/ANSI 6.2.11, states "A rough terrain forklift truck is unattended when the operator is 25 ft or more from the truck, which remains in his view, or whenever the operator leaves the truck and it is not in his view." No Abatement Certification or Documentation Required.
