Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: At the Greenwood Avenue construction site, employees operating the Case Backhoe model 580L, Equipment # 650796 and the Dyna Pac Roller Model CA251, Equipment # 576 were exposed to crushing injuries due to the lack of use of a seat belt.
