Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by/crushing hazards: Job site, maintenance shop area- On or about November 3, 2000, outside side mirrors were not installed on the Ford A-62 split-body front end loader tractor being operated in a forward and backward direction in a work area that was not prohibited to employees. Employees were exposed to struck-by hazards. A feasible and useful means of abatement includes, but is not limited to the following actions: 1) Comply with the industry-recognized practices of the Equipment Manufacturers Institute's and the Construction Industry Manufacturers Association's safety manuals, which state, respectively, that: a) "to protect you and others around you, your machine may be equipped with the following safety equipment (mirrors among others). See that each item is securely in place and in operating condition. b) "if your daily checks uncovers any item that needs attention- repair, replacement, or adjustment- report it promptly. The most minor malfunction could be the result of more serious trouble- or can cause it, if the machine is operated". No Abatement certification or documentation is required for this item.
