Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish a place of
employment which were free from recognized hazards that were causing or
likely to cause death or serious
physical harm to employees in that employees were exposed to the hazard of
being crushed by earth moving
equipped with roll over protection in the event the equipment tipped over
when operating the vehicle near or
on uneven grade levels where rollovers were a possibility. One feasible
and acceptable method to correct this
hazard is insure that the seat belts that are provided on the equipment
are worn by the operator  when the
equipment is on or around uneven grade levels to insure that the operator
stays inside the rollover protection
provided on the machine in the event of a rollover:
A) LOCATION: GILLMORE FARM ROAD
AN EMPLOYEE OPERATING A LARGE CATERPILLAR ARTICULATING DUMP TRUCK, WAS
WORKING IN AREAS WHERE THERE WAS UNEVEN GRADE LEVELS AND HE WAS NOT
WEARING A SEAT BELT. THE TRUCK SLID OFF A  ROAD AND DOWN STEEP EMBANKMENT,
TIPPING A PORTION OF THE TRUCK OVER. THE OPERATOR ENDED UP OFF THE TRUCK
AND
OUTSIDE OF THE PROTECTION GIVEN BY THE ROLL OVER CAGE ON THE TRUCK.
