Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to serious injury from being struck by a motorized sliding gate because the gate lacks any type of contact sensor or current monitor that would help eliminate the hazard of being caught between the closing or opening of the gate. One method of abatement to correct this hazard would be to have the leading edge of the gate be a continuous piece that activates a series of limit switches that would reverse the action of the gate. To prevent employees from being caught between the gate and the stationary fence when the gate is opened, a stationary second fence needs to be installed so that the gate opens into a fenced-in area.
