North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious injury or serious physical harm to employees in that employees were exposed to: a) within the Cato Corporation, Distribution warehouse, Level 1, employees were subject to the trolleys and carriers falling from the rail system. NOTE: Among other methods, one feasible and acceptable method to abate this hazard would be to extend the saddle sides of the trolleys and carriers riding on the rail system.
