ORS 654.010:  The employer did not furnish a place of employment which was
safe and
healthful for employees, and did not do every other thing reasonably
necessary to protect the
life, safety, and health of the employees:
(a) The employer had not done every thing reasonable to provided a safe
work place as can be
determined by:
1. Employer failed to establish effective plant radio communications.
"Callers/users"
failed to identify themselves, and the "receiving user" failed to confirm
their identity at
the start of call, nor did they confirm the message was received before
work was allowed
to start.
2. Affected workers were not all notified when workers were exposed to
possible chip
burial during clean up.an
