North Carolina General Statute 95-129(1) of the Occupational
Safety and Health Act of North Carolina:  The employer did not
furnish to each of his employees conditions of employment and a
place of employment which were free from recognized hazards that
were causing or likely to cause death or serious physical harm to
employees:
a)jobsite, On 11/15/2000 employees working from
a wooden platform raised by a Lull Forklift,
the platform contained an open side and
damaged floor.  The employer did not take
measures to protect employees from being
exposed to a fall hazard and did not ensure
that the platform was properly designed and
constructed.
NOTE:Among other methods, one feasible and
acceptable method to abate this hazard is to
construct and install the platform with a
railing in accordance with ANSI B56.6 and
ANSI B56.1.  Employees must also be equipped
with fall protective systems as outlined in
29 CFR 1926 Subpart M- Fall Protection.
