Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to "struck by" hazards when TEREX trucks and a CATARPILLAR truck were being driven with critical deficiencies. a) Terex trucks #8, serial #B22673, used to transport metal scrap, was being operated without brakes, backup alarm, horn, side mirrors, and the drivers pin window glass was shattered. b) Terex truck #5, serial #63G1989, used to transport metal scrap was being operated without side mirrors, back up alarm was not above the ambient level, access door was broken and could not close and the door window glass was missing, driver's pin window glass was shattered, windshield wipers were not provided, driver's access platform was not provided with handrails. c) Terex truck #3, used to transport metal scrap was being operated without brakes, a back up alarm, drivers access platform was not provided with handrails, passenger side mirror was not provided and passenger access ladder was in disrepair. d) Terex truck #6, serial #67702, used to transport metal scrap was being operated without brakes, backup alarm, horn, no side mirrors, wipers, drivers door was unable to close, fire extinquisher was missing. e) Catarpillar truck #2, used to transport metal scrap was being operated without brakes, a backup alarm or horn, side mirrors, drivers access platform was not provided with handrails, a piece of cardboard was taped onto the lower portion of the drivers door frame to close off the lower half of the door, the upper portion of the door was not provided with any type of enclosure. Among other methods, one feasible and acceptable abatement method to correct this hazard is to: 1. Develop and implement procedures to remove from service trucks that are unsafe. 2. To meet the manufacturers standard safety features such as not be limited to maintaining the brake system, antiskid walkways and safety rails to provide safe access to either side of the cab, side view mirrors, seat belts, reversing audible alarm, horn, heater and defroster, etc. Violation observed on or about 1/11/01
