North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees conditions of employment and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees:
a)jobsite, U-Liner Mid-America, Inc. dba CSR Hydro Conduit
failed to develop and implement a written confined space
program for employees who were entering sewer and water
line manholes, failed to perform pre-entry confined space
air monitoring for oxygen, toxic gas and flammable gas
content with a calibrated direct reading instrument,
failed to perform continuous testing of the confined
space atmosphere to determine if an oxygen deficient,
toxic gas and/or flammable environment would arise during
operations, failed to complete confined space entry
permits, and failed to implement procedures for and
provide an attendant/standby person at the confined space
entrance opening.
Feasible and acceptable methods to correct this hazard
include, but are not limited to:
1.Develop, implement and enforce a permit-required confined
space program in accordance with 29 CFR 1910.146 North
Carolina Occupational Safety and Health Standard for
General Industry.
2.Develop, implement and enforce a confined space program
in accordance with American National Standards Institute
(ANSI) Z117.1-1995.
3.Perform atmospheric testing or monitoring of all confined
spaces such as, but not limited to, manholes with a
calibrated direct reading instrument for oxygen content,
flammable gases and toxic air contaminants in accordance
with the instrument manufacturer's recommendations.
4.Perform atmospheric testing or monitoring of all confined
spaces such as, but not limited to, manholes continuously
while employees are in confined spaces.
5.The completion of confined space entry permits for each
entry into a confined space which certifies that all
existing and potential hazards have been evaluated by a
qualified person and necessary protective measures have
been taken to ensure the safety of each employee.
6.Provide an available attendant at the entry of the
confined space to monitor conditions and implement
emergency rescue procedures if necessary.
