General-duty citation text
Section 5(a)(1) of the Occupational safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a. On or about November 16, 2001, Baja Foods, LLC., employees were exposed to releases of anhydrous ammonia which was used as a refrigerant in the plant. The exposure can cause chemical burns to the lungs. Ammonia releases might occur as a result of, but not limited to, the following: 1. In the engine room the doors connecting to the boiler were not tight fitting and self closing type. Piping from the engine room was not tightly sealed to the wall through which it passes. 2. Remote control of the mechanical equipment was not provided immediately outside the engine room door, nor was a control switch provided for the ventilation in that room. 3. Cook room - pipes involved with the refrigeration process (suction line, liquid ammonia, hot gas ammonia) were not labeled and identified. 4. Self-Contained Breathing Apparatus (SCBA) respirators located outside the engine room were not provided. 5. Schematic drawings or panels giving directions for the operation of the refrigeration system were not provided. 6. A sign reading Authorized Personnel Only was not posted on the door of the engine room. Feasible methods of abatement for each of the above include, but are not limited to, adherence to the safe design, installation, and operation of ammonia refrigeration systems as prescribed by the ANSI/ASHRAE 15-1994 standard (Safety Code for Mechanical Refrigeration). NOTE: 29 CFR 1903.19 Requires that you provide certification and documentation of abatement for this item.
