Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the condition(s) listed below: At the job-site, located at 11002 E. I-40 & Pullman Road, Amarillo, TX 79101: Employees, at times, were required to work from mobile ladder stand platforms that were defective, were not designed with a system to prevent movement, and were being used on improper surfaces. These conditions exposed employees to falls from 7 1/2' heights and/or being struck by a toppling ladder stand, for the period of time up to and including 03/22/01. Among others, some feasible and acceptable methods to correct these hazards would be to: 1) Equip mobile ladder stands with a system to prevent the unit from moving horizontally. 2) Properly inspect, setup, use, and maintain mobile ladder stands in accordance with the Manufacturers' instructions. 3) Do not use mobile ladder stands on a sloped (unlevel) surface. Consider installation of a fixed elevated work platform / walkway for employees to use when they scrub / wash the upper areas of the trucks / trailers. 4) Fit the mobile ladder stands with the proper size wheels (with bushings that fit the spindles) to make it less likely that the unit would topple while in use or when it was being moved. 5) Instruct each employee in the proper use of the Mobile Ladder Stand.
