General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the condition(s) listed below: a) Where employees were assigned to clear a blockage from the battery condenser, they were required to stand on a platform that was located 24 feet from the floor and over 9 feet from the bottom of the lint slide. A guardrail was located on the north side of the platform to protect employees from falling off of the platform. The midrail on the guardrail had been moved up to 37 inches from the platform, thus minimizing it's effectiveness. Employees were thus not fully protected against the hazards of injury from falling, including but not limited to broken bones, internal injury, and death.
