Code of Virginia - 40.1-51.1(a): The employer, Tire Distribution Inc., did
not furnish each of
their employees a safe employment and a place of employment which is free
from recognized
hazards that are causing or likely to cause death or serious physical harm
to employees, in that
employees operate a freight elevator which exposes them to:
(a) Amputations, fractures, or a permanent disability by not having a door
interlocking device or
gate with mechanical locks & electric contacts to prevent the elevators
travel when the door is
open.
(b) Amputations, fractures, or a permanent disability by not having their
elevator(s) regularly
inspected.  ANSI standard 17.1-1990 requires elevators to be inspected at
intervals not longer
than six months, including Routine, Periodic Inspections (annually & test)
and five year test
requirements.
This hazard is recognized throughout the industry; and by ANSI  A17.1990,
American National
Standards Safety Code for Elevators and Escalators.
One feasible and acceptable abatement method, among others, to correct
this hazard is to equip
the elevator with  Hoist-door locking devices and to inspect and test
elevators to determine their
safety and compliance with the requirements of this code before being
placed in service.
The freight elevator door is rusted/corroded open, and would not close
when the elevator is
departs the landing zone on the 1st floor level, or  second floor.  It is
not equipped with an
interlock device which prevents the elevator from traveling between the
1st floor and 2nd floor
when the overhead door open.
The freight elevators are not inspected at intervals at least every six
months: Routine and
Periodic inspections were not performed in the past year.
