Section 40.1-51.1.(a)-Code of Virginia: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a possible fall hazard while working on a ladder with a broken side rail that had not been inspected for possible defects. "One feasible method of abatement among others would be to initiate a ladder inspection program and train employees to recognize the hazards associated with working on defective ladders." Reference standard: ANSI A14.5-1982 paragraphs 9.4.1 and 9.4.2.
