Title 40.1-51.1. (a), Code of Virginia:  The employer, J. Harman Saunders
Construction Co., did not furnish
employment and a place of employment which were free from recognized
hazards that were causing death or serious
physical harm to employees in that approximately 60 protruding drive pins
were uncapped in the area where the curb
and gutter had been formed. There were 3 employees observed in close
proximity and stepping over the drive pins.
The drive pins ranged in height from one to sixteen inches above the
ground.
"One feasible and acceptable abatement method, among others, to correct
this hazard is to cap all drive pins
immediately after driving the pins into the ground.
