Title 40.1-51.1.(a), Code of Virginia: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: (a) At this jobsite, the 6 in. wide rear bumper, installed on the GMC van that was being used to transport employees to their work stations, had been used to transport an employee. "On May 24, 2001, at approximately 8:00 am, an employee was seriously injured when he fell from bumper of the GMC van while being transported to his work location in full view of the jobsite Superintendent". "ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD, AMONG OTHERS, TO CORRECT THIS HAZARD IS TO REQUIRE THE VEHICLE OPERATOR TO ENSURE THAT ALL EMPLOYEES BEING TRANSPORTED WERE SEATED INSIDE THE VAN PRIOR TO MOVING ".
