Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. employees were exposed to being struck by the counterweight of the excavator. Employees worked by the Caterpillar crawler excavator. No protection was provided to ensure employees were not in the area of swing during work. Among feasible abatement methods is to barricade or cone the area of swing and train the employees to the hazard of the swing radius. NO CERTIFICATION OR DOCUMENTATION REQUIRED FOR THIS ITEM.
