Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not establish employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm in that employee(s) were exposed to the hazard of falls from an aerial lift: On or about August 21, 2001, employee(s) using an aerial lift to paint a cinder block wall area above the overhead door in the dock bay area, had not received adequate training, due to the language barrier, in the operation of self propelled elevating work platforms nor did the employer have proof and/or evidence of their training. Among other methods, one feasible method to establish and enforce adequate safety programs with specific training relating to the use of self propelled elevating work platforms and procedures such as those stipulated by the operators manual supplied with the lift and ANSI A92.6-1999 Self Propelled Elevating Work Platforms. Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not establish employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm in that employee(s) were exposed to the hazard of being struck by the overhead garage door: On or about August 21, 2001, employee(s) using a scissor lift to paint a cinder block wall area above the overhead door in the dock bay did not affix lockout devices or otherwise disable the overhead door to prevent unexpected/expected or unintentional/intentional energization or operation of the overhead door. Among other methods, one feasible and reasonable method to correct this hazard would be to implement and enforce the American National Standards Institute's standard for personnel protection-lockout/tagout of energy sources-minimum safety requirements as specified in ANSI Z244.1-1999. NO DOCUMENTATION OR CERTIFICATION REQUIRED FOR THIS ITEM IN THE ALTERNATIVE: 29 CFR 1910.147(d)(4)(i): Lockout or tagout devices were not affixed to each energy isolating device by authorized employees: On or about August 21, 2001, employee(s) using a scissor lift to paint a cinder block wall area above the overhead door in the dock bay did not lockout or otherwise disable the overhead door to prevent unexpected/expected or unintentional/intentional energization or operation of the overhead garage door.
