Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. Employees were exposed to being struck by the counterweight of the excavator. Crawler Excavator did not have any barricades or warning cones to identify the swing of the counterweight. Among feasible abatement methods is to cone or barricade the area of the counterweight swing. NO CERTIFICATION REQUIRED FOR THIS ITEM.
