Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not provide a place of employment that was free from recognized hazards in that employees were exposed to having their head and torso entrapped between the truck and ground in the event of tip over. Among feasible methods to abate this hazard is to comply with the American National Standard Institute (ANSI) Safety Standard for Low Lift and High Lift Trucks, ANSI B56.1- 1988, Section 5.3.19 and wear seat belts at all times operating the truck. In the warehouse area of the plant, employee(s) operating Toyota fork lift truck #12859 were not required to wear the seat belt that was provided on the truck.
