Section 5(a)(1) of the Occupational safety and Health Act of 1970:  The
employer did not furnish
a place of employment which was free of recognized hazards that were
likely to cause serious
physical harm or death in that employees were exposed to collapse related
hazards.
Nature's Point Subdivision jobsite.  Employees marking measurements with
stakes near a soil
pile were exposed to collapse related hazards.  One employee suffered
fatal injuries and another
suffered severe internal injuries when the soil pile collapsed onto them.
Among feasible means of abatement would be to:
1)  Determine the soil type and slope or bench accordingly.
2)  Stay a safe distance from the soil pile.
3)  Remove the soil pile from the area where employees will be staking out
measurements.
OR IN THE ALTERNATIVE
29 CFR 1926.250(a)(1) - All materials stored in tiers shall be stacked,
racked, blocked,
interlocked, or otherwise secured to prevent sliding, falling or collapse.
